Terms of Service

These terms govern your use of 11-11 ("the Service") — the web app at 11-11.art and the 11-11 browser extension. By using the Service you agree to these terms.

1. Who we are

The Service is operated by 11-11 ("we", "us"). Questions about these terms: support@11-11.art.

2. The Service

11-11 is a fully digital service. It shows a new piece of art (created with the help of AI) as the day turns, drawn from rotating worlds you can follow, and lets you keep a collection of your own. There are no physical goods.

3. Accounts

You must be at least 13 years old to create an account. Provide accurate information, keep your sign-in credentials secure, and you are responsible for activity under your account. We may suspend or close accounts that breach these terms or that we reasonably believe are being used unlawfully.

4. Acceptable use

You agree not to:

  • use the Service for unlawful purposes or to infringe others' rights;
  • attempt to scrape, reverse-engineer, overload, or circumvent rate limits or security of the Service; or
  • resell or commercially exploit the Service or the art without our permission.

5. The art & your collection

We own the art. All art and other outputs produced by the Service are owned by 11-11. As between you and us, 11-11 holds all copyright and intellectual-property rights in them. You do not receive any ownership of, or commercial rights in, the art.

Your licence to use it. We grant you a personal, non-exclusive, non-transferable licence to view, keep, and share the art you collect, for personal, non-commercial use. For any commercial or other use, you must get our written permission first.

6. Payments

The Service is currently free to use — we do not charge you, and we do not collect payment information. We may introduce paid plans in the future. If we do, we will show the price clearly before you pay, process payments through a reputable third-party provider, and update these terms accordingly. We will never charge you without your consent.

7. Stopping & deleting your account

You can stop using the Service at any time. You can also ask us to delete your account and data by emailing support@11-11.art — see the Privacy Policy for details.

8. Intellectual property

The 11-11 name, software, designs, and templates are ours and are protected by law. The underlying AI models are licensed from third-party providers. Nothing in these terms transfers our intellectual property to you except the limited licence to use generated art described in section 5.

9. Third-party services

We rely on third parties to provide the Service, including Amazon Web Services (hosting and sign-in, which also brokers Google login) and AI model providers (content generation). Your use of the Service is also subject to their terms where applicable. How we handle your data is described in our Privacy Policy.

10. Disclaimers

Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy you may have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other law that cannot be lawfully excluded. Subject to that, the Service is provided "as is": we do not guarantee it will be uninterrupted or error-free, and AI-generated outputs may be inaccurate and are not professional advice.

11. Limitation of liability

To the maximum extent permitted by law, and subject to section 10, we are not liable for indirect, incidental, or consequential loss, and our total liability to you for any claim relating to the Service is limited to NZD $100 or, if greater, the amount you paid us in the 12 months before the claim. Where the Consumer Guarantees Act 1993 applies and our liability cannot be excluded, our liability is limited to re-supplying the Service or paying the cost of having it re-supplied.

12. Changes to these terms

We may update these terms from time to time. If changes are material, we will update this page and, where appropriate, notify you by email or an in-product notice. Continued use after changes take effect means you accept the updated terms. The date at the top reflects the latest revision.

13. Governing law & disputes

These terms are governed by the laws of New Zealand, and you and we submit to the non-exclusive jurisdiction of the courts of New Zealand sitting in Auckland. If you use the Service as a consumer in another country, you may also have the benefit of mandatory consumer protections under your local law. Before starting any formal dispute, please contact us so we can try to resolve it directly.
